Yellow Boxes at T Junctions

The last couple of months have seen a number of successful appeals against yellow boxes situated at ‘T’ junctions that span the full width of the road like this:

The correct configuration, as prescribed in diagram 1044 of the Traffic Signs Regulations and General Directions 2002 is a half box, like so:

Strictly speaking, appeals at the Parking and Traffic Appeals Service (PATAS) do not set precedents for future cases, but there is now a body of consistent cases to form a very persuasive argument for similarly marked junctions. It would take a very brave Adjudicator to rule otherwise.

Effectively, this type of junction is now unenforceable because if you were to appeal against your PCN, you are guaranteed to win. The only exception is if the junction has been authorised by the Secretary of State for Transport, as is the case for instance in Hammersmith and Fulham with the box at New Kings Road and Bagley’s Lane.

So here are the key cases against Ealing and Haringey:

Donnelly –v- Ealing (2070367593) at Ruislip Road & Mansell Road. Mainly due to a high number of complaints, Ealing has now ceased enforcement at this site.

Uteene –v- Ealing (207049423A) and Wilinski –v- Ealing (2070502983) at South Road and St Joseph’s Drive. Ealing is continuing to enforce Avenue Road and High Road in the Southall area. As this is the same layout as the above two, then any appeal will be successful.

My thanks to James Hughes for finding this report from Ealing Council that confirms that they know that there is a problem at South Road and St Joseph’s Drive. But if you look at section 15.2 you will see that they are planning to implement yet another money making box junction at the entrance to the Iceland car park. Is there no limit to the depths that this council will stoop to raise extra revenue?

There are two cases against the junction of Green Lanes and Endymion Road, N4 in Haringey, near Sainsbury’s (above): Patel –v- Haringey (2070406174) and Mccann –v- Haringey (2070526824).

So here’s what to do for this type of junction. You make representation against the PCN by ticking the box that says something like “The contravention did not occur.”

You then write the reasons as “This box junction is not as prescribed by the Traffic Signs Regulations and General Directions 2002. Unless it has been authorised by the Secretary of State for Transport it is unenforceable.

If the Council does not cancel the PCN then I have some appeal documents all prepared. Just leave a comment below for more help.

As for getting your money back after you have paid I have some ideas but I need some volunteers. Any takers? Leave a message…

    i have recently paid a pcn for stopping in a box junction when prohibted. It has been playing on my mind since. in the two photos they show it does not show my number plate. Do i have a case for getting my money back?

    Hi I received a PCN for the box junction on South Rd and St Josephs road, I was behind a bus which subsequently stopped at the pedestrian so I had to stop. They have sent me photos of me stopping for 7 seconds. I appealed using the above wording that it does not comply with regulations but they have turned it down. I am now wanting to send this to the adjudicators, as I am fully aware of the rules and would not stop in the junction unless I had to. So any advice would be very helpful.

    Hello i have recieved a penalty notice for entering the box junction at south rd & st josephs in southhall, heading south with just my front wheels in the junction for a few seconds i was near the kerbside of the road on the otherside of the box was a bus lane so i to get to the right lane but the car to my right pulled of faster causeing me to stop just with my front wheels 2 feet in the box and blocking my exit out of the box.
    (im a black cab driver so im very aware of these boxs,the reason i didn,t go forward to bus lane in front of me because this bus lane does not permit taxis which i was unaware of till i got there so)

    Case Number 2080009884

    I recently won my case against TFL on a box junction infringement. The adjudicator states that “when the vehicle entered the box, there were no stationary vehicles in front of it which meant that it had to stop in the box. It did in fact stop in the box but this was due to a bus moving into the offside lane byond the box after the vehicle had entered the box. I could only show this by getting a video of the alleged infringement which clearly shows the above. If anyone feels that they have the same issue, then this case should help them-

    Got a PCN from Haringey Council, dated 19Feb 2008, with respect to “Entering and Stopping in a box junction when prohibited” in High Road N22 on 9Feb 2008
    I know High Road in Haringey is a hot spot, and wonder if it’s worth appealing.

    My car was stucked behind a car turning in from the right hand side, and blocked me right in the middle of the yellow box……..=(

    Is it worth appealing? can someone please help? Happy to scan you a copy of the notice if required.

    I have received a PCN for Jctn of High St and Avenue Road Southall. I have applied to see video and am attending next week. Looking at the layout of the box it clearly is not marked correctly as regulation allows, unless they have received authorisation from the secretary of state for transport. How do i find out if they have authority? Can this be done quickly before i waste my time viewing the video?

    I have recieved a PCN Bowes Road/Brownlow Road. The junction clearly has 7 sides as its cut away at the corners, and is on a junction with 3 lanes going down to 2. I only have half my back wheels on the box and am not obstructing anyone, just misjudged the gap and the movement of the car in front. Anyone have any advice?

    I have recieved a PCN Lewisham Way/Parkfield Road. This is a ‘T’ junction? But all roads are one way two lanes on Parkfield Road and two lanes plus bus lane on Lewisham Way. What are the legal requirements of markings on this junction, is it classified as a ‘T’ junction or not?

There are 2 pictures seemingly taken at an interval of 5 secs with just my front wheels in the box and I stopped well in time as the exit would have got blocked for some reason, Not sure, if I stayed in the junction for longer. I am planning to call up and arrange for a video viewing but it is a tremendous waste of time I reckon. For sure, the position of the vehicle proves that there was no possibility of a blockage because of my car. Any suggestions how to go about it ?

    I have recently received a PCN for entering and stopping in a box junction when prohibited on New Kings RD junction with Bagleys Lane. As someone who doesnt live in London I had no idea about this money making exercise that is in force and cannot tell from the “still image” that I have been sent just what caused me to stop and more importantly for how long. As I class myself as a careful and responsible driver I do not believe I just stopped in the box junction for no reason at all

    Hi just wanted to update you on our appeal against Ealing council mentioned above for an alledged contravention in South Rd/St. Joseph’s Drive, Southall (18).

    Today some 5 weeks later i received a letter from Ealing council with a great wall of text about how actually this junction is legal.

    However they say they are cancelling the PCN in this case!

    I really cant thank you enough for this site as without it I would have just forked over the 60 quid. If youd like scans of the letters or whatever please get in touch.

    Hi I received a penalty for the yellow box junction situated on South Road and Josephs Road in Southall.
    I was behind a vehicle that stopped suddenly to avoid hitting a pedestrian. Ahead the traffic lights were green and traffic was flowing freely.
    I in turn had to perform an emergnecy stop to avoid collision, unfortunatley stopping in the box junction for about 10 seconds.
    I appealed against the fine and was turned down.
    I would like to know what steps i can take now to avoid this fine. I believe the junction itself does not meet regulations and would not stop in a junction for any reason.

    Please could you send me some appeal documents to proceed with this further

    We had a vehicle (an artic) travelling up Lewisham Way and stopped on the box junction with Parkfield Road. Is this a legal box?.

    As the driver has pointed out to me, if he waited until he had an artics length to pull into on the other side of the junction there would have been a considerable queue of traffic behind him. Any advice gratefully received.

    Hi I’ve recently received a PCN from ealing council with regards blocking the box junction between High Street/Avenue road, the photo’s show my car with its front wheels on the box junxtion and clearly not blocking the exit of the ajoining road. I understand this is an illegal box junxtion with the actual markings not going to the curb and covering both lanes a t-junction. I’m just wondering how other people have got on when appealing, and whether there is any advice as to the best way to do this?

    I followed your advice after receiving a PCN for being in a box juction at Lewisham Way/Parkfield Road and wrote that the box juntion is not as prescibed by the traffic signs regulations and general directions 2002.     I travelled down to London two weeks ago from Birmingham and received a PCN for “stopping in a box junction when prohited in South Road/St. Josephs Drive, Southall (18)”. The photos show all 4 wheels in the box, with the back wheels just on the edge of the box,

    My car is where the yellow car is here http://www.pbase.com/lmag/image/80971842

    the picture is very close and shows no cars infront of me, to the right you can see a small section of the exit to the next road. There is plenty of space for anyone to pull in or out of the junction and i am in no way blocking them.

    The other picture is of my number plate, but infront shows the roof of a car which has jus pulled into the main road from the T junction.

    Id be graetfull if you could supply some information to help me in my appeal.

    I have received a PCN in the last month at the Box Junction at Bush Road/High Road Leytonstone. In this section when you are turning right from Bush raod there are two box junctions to clear. I was turning right and as I advanced into the box junction the cars ahead were all moving forward. I was unable to complete the exit from the junction as the traffic lights a few metres after the second junction had turned red and the cars ahead of me had to stop. I have noticed only 4 cars can safely clear both junctions before the remaining cars have to stop within the junction. Eventhough i was turning right and am aware I am able to enter the box junction I received a PCN and the council have rejected my appeal. I now plan to attend for a personal appeal but am daunted by the task. can you give any advice? Thank you.

    Received a PCN at the box junction at South Road/Cambridge road, Southall. After reading what is stated above about the junction being illegal as it is a T-junction and the box covers the whole road and not just half as it should.
    I appealed to PATAS and received a letter from Ealing council stating that they would not be challenging my appeal and it had been closed.
    Fight them, all the box junctions on South Road are illegal!!

    The following Ealing box junctions do not conform to the relevant regulations (at least according to the Adjudicators), and therefore Ealing Council will not contest your appeal if you take it as far as The Traffic and Parking Appeals Service. They will try and screw the cash out of you right up until that point, with threatening letters, but persevere and it will pay off:

    High Street junction with Avenue Road
    South Road junction with Cambridge Road
    South Road junction with St Josephs Drive
    Ruislip Road junction with Ruislip Road

    Any others where it is a T-junction, and the YBJ covers both sides of the carriageway,are generally not valid. The information at the top of this article explains it better, but don’t bother downloading previous appeals as it’s not neccesary. Just write to the Council telling them they can go jump, and that they should sort out their crappy junctions. Don’t give those bas%^&ds anymore of your hard earned cash. Power to the people!!!

    and like I say Ealing eventually sent me a letter back saying that the junction was legal and that the guidelines were just guidelines but that this time they would let me off anyway!

    I only came back to look at this web site as there is an article on BBC breakfast news this morning about illegal yellow boxes and other road markings and there was a guy from some council or other stating that no council would ever continue to enforce a yellow box if it had been adjudicated to be illegal.

    Well I think we all know different so I have emailed the BBC a great long email about Ealing Council and their frankly illegal practices.

    Anyway I will try to find the letter I got from Ealing later this evening and scan it.

    I received a penalty charge notice for entering the box on the South road/St. Joseph’s drive junction last week. I wasnt aware of the regulations that you mentioned above, so entered an appeal, stating that the person in front of me unnecessarily braked and stopped, which caused me to stop momentarily in the box.

    They have rejected this and sent me a form where I can appeal to an independent adjudicator. I would appreciate if you could send me any docs you have to contest this appeal. Also I would like to confirm that if I lose this appeal, will I be liable for the £120 fine, or will they still allow me to pay £60.

    I have recieved a notice of rejection for the same offence as Neil Hadfield. Mine occured on the Archway Road/Shepherds Hill cross roads. I have stopped in the box junction for exactly 8 seconds and i have recieved a PNC.
    The TFL have not replied to any of my representation, just totaly ignored that the box junction was in a poor state of repair,did not touch the curb on all four sides and there was no notifiaction before the junction to warn drivers to the approaching hazzard. They have just quoted that “You must not enter the box unless you can cross over it completely without stopping”. As i am disputing the validity of the box junction how can they ignore this and just reject the representation?? Any help would be greatly appreciated!!

    I received a PCN for the South Road/Cambridge Road box junction. Made a representation as above but it was rejected. Ealing Council say it is compliant and the guidelines are just that, guidelines. As stated on a previous post the BBC did a story on such initiatives so I will be appealing to the Adjudicator.     Hi there,

    I received a PCN for stopping in a box junction, and I’m planning to appeal against it due to the bx junction being incorrectly marked. Specifically, in contravention of ‘Schedule 6 Road Markings (cont) at http://www.opsi.gov.uk/SI/si2002/023113by.gif that one of the angles is noticably over 130 degrees, and therefore outside the permitted range of 60 to 120 degrees.

    A few year back, I got done at “The Broadway – Junction of Herbert Road” T Junction in Southall. It is correctly marked as a T Junction but it over-marked by a yard.

    In the photo provided there are two pedestrians crossing the road, forcing me stop earlier than I would have done otherwise. One pedestrian is right in front of my car.

    The pedestrians are only a few yards away from the pedestrian crossing, which is why I had to stop and yet these pedestrians had to cross in front of my car.

    But their actions don’t count when you appeal to the money grabbing Ealing Council.

    I GOT A PCN AT ARCHWAY RD/ SHEPHERDS HILL, THE ROAD AHEAD CLEAR SO I DROVE FORWARD, BUT CARS FROM THE OTHER LANE WHEN IN THE CARS IN FRONT OF ME AND I GOT STUCK ON THE JUNCTION BOX, THE PICTURE SENT TO ME SHOWED CARS WERE ON 3 LANES AS SUPOSED TO 2 LANES, THAT WAS BECAUSE CARS WERE TRYING TO ENTER MY LANE, WHEN I RANG TFL I WAS TOLD THAT THEY COULD SEE 3 LANES WHICH WAS NOT TRUE, I WAS STILL TOLD I HAVE TO PAID THE FINE, CAN ANYBODY HELP ME OUT HERE.

    I have received a PCN from tfl for entering a yellow box in New Cross. However, tfl then ignored my appeal, sent me a charge certificate, then months later sent me an appeal rejection dated in the past.

    I have applied for a PATAS appeal as the box junction itself looks oversize and I think my rights were prejudiced by receiving a charge certificate before my appeal rejection and again when my appeal rejection was issued the discount period was in the past and had already lapsed.

    Any appeal help would be very appreciated.

    I have got a TFL pcn for a yellow box junction code 31, at Battersea Rise/Northcote Road SW11, firstly on turning left on my journey the lights changed so ppl could cross the road which meant that two vehicles were in the box, i got done so i don’t know if the van in front did too. anyway i think by the pics i’ve seen on here so far that this box isn’t right, can anyone tell me ?
    also the pcn is addressed to me as the company secretary which i am not, it’s a private vehicle. Another westminster pcn awaits payment as i appealed against being parked on a yellow line with blue badge on, didn’t know they had different parking regs!!!! can i appeal again on what grounds, i had stated as a carer i had to stop and let the person out to use the toilet!!

    I have just got a PNC notice For “31: enteringand stoping in a box junction when porhibited” . At the Great Eastern St /curtain Rd junction in Hackney , When a lorry stoped suddenly i had to stop and was half in half out of the box . The photos show i was there 10 sec untill the lorry and them me could move foward enough Any thoughts
    i live in wilts and with the cost of fuel and this fine i lost money on this days work .i dont know how you stand this stuff if you live in london all the time

    If yes then which one of the five grounds on the reverse of the PCN shall I use?

    My PCN states “The person on whom this notice is served may be entitled to make representations under paragraph 1 of Schedule 1 of the London Local Authorities & Transport for London Act 2003, using the form overleaf. The grounds on which you make representations are set out in the form. If you do not make representations and the penalty charge is not paid before the end of the 28 day period, an increased charge of £180 may be payable. The Council of the London Borough of Ealing may disregard any such representations, which are received by them after the end of the period of 28 days beginning with the date on which the penalty charge notice in question was served.”

    Can I appeal against this PCN on the basis of PATAS case 2070445427 Pulp Faction Recycling –v- Islington ?

    If yes then which one of the five grounds on the reverse of the PCN shall I use?

    Following five ground for representation are there on the back of PCN –

    I never was the owner of the vehicle in question/ I ceased to be its owner before the date on which the penalty charge was alleged to have become payable/ I became its owner after that date (1)

    There was no contravention of a prescribed order/ failure to comply with an indication on a sign/ contravention of the lorry ban order (2)

    That at the time the alleged contrvention or failure too place the person who was in control of the vehicle was in control of the vehicle without my consent (3)

    We are hire firm and the vehicle in question was the material time hired under a vehicle hiring agreement and the prson hiring it had signed a statement of liability acknowledging his liability in respect of any penalty charge notice issued in respect of the vehicle during the currency of the hiring agreement (4)

    The penalty charge exceeded the amount applicable in the circumstances of the case (5)

    Dear Sir,

    I have recently received a PCN from Islington Council for a yellow box junction contravention. Since I had paid £340 for six PCNs to central London councils this year, I was in no mood to do the same again just to avoid the trouble. After some searching, I found your site and without hesitation decided to challenge the PCN.
    The following are my grounds for refusing to pay:

    1. The location of the contravention as stated in the PCN is ‘Drayton Park N5’. This is not enough to describe a junction.

    2. The photographic evidence does not show my car before or during entering the box.

    3. The box itself (I am assuming it is at Drayton Park/Horsell Road junction) deviates from the design specifications laid out in TSRGD in the following points:

    •The yellow lines do not go into the corners of the box.

    •The box does not go right up to the kerb. The southeastern and
    southwestern corners are 25 cm and 64 cm from the kerb respectively.

    I have filled in the representation section following your advice and sent it to the council by recorded delivery. I am now waiting for a response.

    The lesson I have learned from your site and others is to challenge every PCN. I have even gone further and dug out all the previous PCNs I had sheepishly paid to see if any money could be recovered. Of course I shall keep you updated of any progress.

    Finally, I would add my voice to yours and say ‘FIGHT BACK’.

    I received a PCN for the Yellow Box in Kensington High St/ Warkick Rd W14.
    I’m right at the end of the box, and remember that i had to stop because a taxi decided not to go on the bus lane but move to the right lane.
    I want to know, if there is a way of seeing the video footage, and also if this box has been aproved? thanks a lot

    I had 2 back wheels in a box juction due to the traffic lights changing once I have gone inside the box junction area it was either break a red light and run over predestrians or stay put not causing a nusciance or obstruction and the f***kers are now trying to charge me as my first appeal was unsuccessful if u have any more appeal letters they would be appreciated

    Yellow box -High Rd leytonstone/Bush Rd – got a PCN & have appealed to PATAS on grounds that 2nd box is not visible in time to stop due to slope of Bush Rd & camber of the High Rd. Has anyone had any success with appealing this junction or others on visibilitu grounds?

    I received a PCN for yellow box junction on Archway Rd/ Sheperds Hill. The photos show that only my back wheels are in the box and there is a bus stop just infront of the box. Is there anything I can do? Can anyone help?

    The Yellow Box Junction at Lewisham Way and Parkfield Way does not conform to the regulations set out by the Department of Transport. I have had a case at the Traffic Tribunal Office. The Adjudicator has given his judgement in my favour that I have proved that the junction is illegal and therefore the ticket that was given cannot be enforced. The case number if quoting is 2080206014. The Transport for London sent all kinds of information that was irrelevant. So if you get a ticket in this junction you need to fight it as an illegal junction ….

    Thank you for your post. I’m challenging a pcn issued to me for that same junction. I informed TFL that the junction is illegal and they have just sent me a notice of rejection. I am going to PATAS and thank you for your case no as reference. At Goldsmiths we have problems everyday entering that box as Lewisham way and parkfield are controlled by lights and our exit out of the university leads right into the yellow box junctionj. I will let you all know how i get on.

    Have been issued with pcn for christchurch rd/priory rd SW19. Code 31. (No j) enforced by camera. Was in line of moving traffic which was forced to stop at red light at pedestrian crossing at virgin active gym end of box. I did not block right turn. Is this enforceable? Also pcn states 14 days discount. Should this be 21 days as pcn issued through video evidence? Also, is this box marked correctly? Any comments welcome as i am not a londoner and have been staying in premier inn for 5 months. Use junction 4/5 times a week and this is my first pcn. Thanks for any help.
